Abstract

This article deals about the opposition between letter and action, resulting in the opposition of scholars and warriors. It argues that it has participated in the configuration of country history, being that the writing has ordered the signs of power according to the oligarchic interests and led to fold the forces that attempted to control power but without being able to become a Constitution. After military victories, the scholars assume the direction of the political process destroying to meaningless the claims that led poor people to give their lives for the country. Owners’ Rights are imposed, expropriations are legitimate and the regime of 'private property' extends. The letter of the law removes the right to freedom conquered in the fields of battle. It is fair to remember that laws should not be dead letter, but living letter: constituent power.
